Since our establishment in 1992, we have specialized in offering exceptional leisure and adventure travel packages to a variety of stunning destinations, including Nepal, Bhutan, India (Kashmir, Sikkim, and Darjeeling), Tibet, Sri Lanka, Central Asia, Kazakhstan, Kyrgyzstan, Tajikistan, Pakistan, Vietnam, and Cambodia.
Please read these Terms & Conditions carefully before booking a tour or using the services of Brothers Adventures. By engaging with our adventure travel agency, you agree to be bound by the following terms and conditions:
1.1 Reservation: To secure your booking, a non-refundable deposit or full payment, as specified for each tour, is required at the time of booking. The remaining balance must be paid by the specified due date, which will be communicated to you at the time of booking.
1.2 Payment Methods: We accept payment via bank transfer, credit cards, or other payment methods specified during the booking process. Any additional fees or charges associated with your chosen payment method will be borne by you.
1.3 Pricing: Tour prices are quoted in the specified currency and are subject to change without prior notice. Once you have made a booking and paid the required deposit, the price of your tour is guaranteed, unless stated otherwise.
2.1 Cancellation by You: If you need to cancel your booking, you must notify Brothers Adventures in writing. The cancellation will be effective from the date of receipt of your written notification. Cancellation fees may apply, and the amount refunded will depend on the cancellation policy specified for your particular tour.
2.2 Cancellation by Brothers Adventures: Brothers Adventures reserves the right to cancel or reschedule a tour due to unforeseen circumstances, including but not limited to insufficient participants, natural disasters, political instability, or other factors beyond our control. In such cases, you will be offered an alternative tour or a refund of the amount paid, at our discretion.
2.3 Refunds: Refunds, if applicable, will be processed in accordance with our cancellation policy. Please note that any bank fees, currency exchange differences, or non-refundable costs incurred by Brothers Adventures will be deducted from the refund amount.
3.1 Mandatory Insurance: It is mandatory for all participants to obtain comprehensive travel insurance that covers medical expenses, trip cancellation/interruption, emergency evacuation, and other potential risks associated with adventure travel.
3.2 Insurance Responsibility: It is your responsibility to ensure that your insurance coverage is adequate for the activities and destinations included in your chosen tour. Brothers Adventures is not responsible for any expenses, losses, or damages not covered by your insurance policy.
4.1 Travel Documents: It is your responsibility to ensure that you possess valid passports, visas, permits, and any other required travel documents for the countries you plan to visit during the tour. Brothers Adventures will provide general guidance and assistance, but we are not responsible for any issues arising from inadequate or expired travel documents.
4.2 Health Requirements: Some tours may require a certain level of physical fitness or have specific health requirements. It is your responsibility to ensure that you are in good health and have the necessary fitness level to participate in the activities included in your chosen tour. We recommend consulting with a medical professional before undertaking physically demanding activities.
5.1 Itinerary Changes: While we make every effort to adhere to the planned itinerary, circumstances such as weather conditions, natural disasters, political instability, or other factors beyond our control may necessitate changes. Brothers Adventures reserves the right to modify, alter, or cancel any part of the itinerary if deemed necessary for the safety and well-being of participants.
5.2 Tour Exclusions: Unless specified otherwise, our tour prices do not include international or domestic airfares, airport taxes, visa fees, travel insurance, personal expenses, gratuities, meals not specified in the itinerary, and any other items not explicitly mentioned as included in the tour description or booking confirmation.
6.1 Compliance: Participants are expected to comply with local laws, customs, and regulations of the countries visited during the tour. Brothers Adventures reserves the right to remove any participant from the tour if their behavior is disruptive, jeopardizes the safety of others, or violates local laws or regulations.
6.2 Assumption of Risk: Participation in adventure activities carries inherent risks. By joining a tour with Brothers Adventures, you acknowledge and assume all risks associated with adventure travel, including but not limited to accidents, injuries, illnesses, and property damage. You are responsible for your own safety and well-being throughout the tour.
7.1 Release of Liability: Brothers Adventures, its directors, employees, agents, and representatives shall not be liable for any loss, injury, damage, delay, or inconvenience caused by any act, omission, or negligence of any third party, including but not limited to airlines, hotels, transportation companies, and tour operators.
7.2 Force Majeure: Brothers Adventures shall not be liable for any failure or delay in performance, or for any loss or damage, due to causes beyond its control, including but not limited to acts of God, natural disasters, war, civil unrest, government actions, or other unforeseen circumstances.
7.3 Limitation of Liability: In no event shall Brothers Adventures’ total liability exceed the amount paid by you for the specific tour in question. Under no circumstances shall Brothers Adventures be liable for any indirect, incidental, consequential, or punitive damages arising from your participation in the tour or use of our services.
8.1 Ownership: All intellectual property rights, including but not limited to trademarks, logos, website content, and tour materials, are the property of Brothers Adventures. You agree not to use, modify, distribute, or reproduce any intellectual property owned by Brothers Adventures without prior written consent.
9.1 Applicable Law: These Terms & Conditions shall be governed by and construed in accordance with the laws of Singapore.
9.2 Dispute Resolution: Any disputes or claims arising out of or in connection with these Terms & Conditions shall be subject to the exclusive jurisdiction of the courts of Singapore.
If any provision of these Terms & Conditions is deemed invalid, unlawful, or unenforceable, the remaining provisions shall remain in full force and effect.
Brothers Adventures reserves the right to amend or update these Terms & Conditions at any time without prior notice. The most current version will be posted on our website.
